VODSTR give a new experience for Indonesian market to enjoy entertainment over the Internet. <h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.55pt; font-size: 12pt; font-family: Arial, sans-serif;">GENERAL<o:p></o:p></h1>VODSTR reserves the right to add and modify the provisions of these Terms of Use. line-height: 13.45pt; font-size: 12pt; font-family: Arial, sans-serif;">USER LIABILITY<o:p></o:p></h1>In using the service, the User is prohibited from doing the following things:<o:p></o:p>1.  Providing false information when registering and updating information or using another member ID illegally.<o:p></o:p>2.  Duplicating, distribute, or commercially use the information obtained from the VODSTR service.<o:p></o:p>3.  Installing indecent content or a link to a page WEB indecent into service.<o:p></o:p>4.  Communicate with the other party with information, text, images or sounds that disturb the public order and moral neglect.<o:p></o:p>5.  Install or distribute any material that contains a computer virus which lead to malfunction of equipment related to the service, damaging information and generate chaos.<o:p></o:p>6.  Deliberately disrupt operations services, send information that may interrupt the delivery of services.<o:p></o:p>7.  Distribute false information for the sake of personal monetary gain or other party, or a desire to harm others.<o:p></o:p>8.  Modify or change the information posted on the service.<o:p></o:p>9.  Threaten other members, including stalking them.<o:p></o:p>10.  Violating the provisions of the draft Penal Code, the Code of Civil Code, Law on Information and Electronic Transaction, Law on Copyright or conduct illegal activity or other criminal.<h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.6pt; font-size: 12pt; font-family: Arial, sans-serif;">LIBERATION<o:p></o:p></h1>Users agree to indemnify and hold harmless VODSTR, subsidiaries and or affiliates, and directors, commissioners, officers, employees, agents and representatives from any claim or demand, including reasonable attorneys’ fees, made by any third party on or arising from use of the Services by the User VODSTR, the violation of these Terms of</div><div class="WordSection3" style="page: WordSection3;">Service by the User, or falsification of an intellectual property rights by users, of intellectual property rights or other rights of any person or other entity.<h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.55pt; font-size: 12pt; font-family: Arial, sans-serif;">JURISDICTION<o:p></o:p></h1>If there is a dispute between the Company and a Member of the use of the Service, the Company and the Members are trying to solve it by consensus.<o:p></o:p>In the event that the dispute can not be resolved if it can file charges in court in accordance with the Civil Code.<h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.7pt; font-size: 12pt; font-family: Arial, sans-serif;">EFFORTS FOR VIOLATION OF THESE TERMS BY USERS<o:p></o:p></h1>If VODSTR decide, in its sole discretion, that the User has breached any portion of these Terms of Service, or have been found guilty of inappropriate conduct against VODSTR Service, the VODSTR entitled to<o:p></o:p>(I)  give a warning to the User that the User has violated these Terms of Service;<o:p></o:p>(II)  terminate VODSTR Services to Users;<o:p></o:p>(III)    notify and / or cooperate fully with law enforcement authorities or other competent authorities for further action; and / or<o:p></o:p>(Iv) any other action which in the judgment VODSTR and appropriately.<h1 style="margin: 2.7pt 0cm 0cm 5pt; line-height: normal; font-size: 12pt; font-family: Arial, sans-serif;">STREAMING SERVICE QUALITY<o:p></o:p></h1>Best Effort quality is in accordance with the quality of internet bandwidth that is owned by the Customer.<h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.7pt; font-size: 12pt; font-family: Arial, sans-serif;">ETCETERA<o:p></o:p></h1>If any provision of the Terms of Service conflicts with the law applicable to these Terms of Service or if any such provisions are held invalid by a court with jurisdiction over the parties of the Terms of Service, such provision will be deemed to be restated to reflect as nearly as possible the original intentions of the parties accordance with applicable law, and other services provisions of these Terms of Service remain in full force effectively.<o:p></o:p>The failure of one party to force or carry to the other obligations under the Terms of Service or exercising rights hereunder, shall not be considered as a waiver or release of any right of either party to sue or rely on any provision or right therein or other events, however, the same thing will apply.<o:p></o:p>VODSTR may assign its rights and obligations under these Terms of Service and to the transfer VODSTR be relieved of any obligations under these Terms of Service.<o:p></o:p>Terms of Service and other Additional Terms is a comprehensive regulatory agreement between the parties relating to the cases set forth in these Terms of Service, and</div>supersedes all agreements and understanding that have been there before. MediaStar memberikan pengalaman baru bagi pasar Indonesia untuk menikmati hiburan melalui Internet.<o:p></o:p><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.55pt; font-size: 12pt; font-family: Arial, sans-serif;"><o:p> </o:p></h1><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.55pt; font-size: 12pt; font-family: Arial, sans-serif;">UMUM<o:p></o:p></h1>MediaStar setiap saat berhak menambah dan mengubah ketentuan Syarat Pemakaian ini. Pengguna mengerti dan setuju bahwa ketentuan tambahan tersebut secara otomatis menjadi satu kesatuan dengan Syarat Pemakaian ini.<o:p></o:p><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.6pt; font-size: 12pt; font-family: Arial, sans-serif;"><o:p> </o:p></h1><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.6pt; font-size: 12pt; font-family: Arial, sans-serif;">PENGHENTIAN DAN PEMBATALAN<o:p></o:p></h1>MediaStar berhak, atas pertimbangannya sendiri, dengan segera, baik tanpa sebab maupun tanpa pemberitahuan, menghentikan atau membatalkan untuk sementara dalam jangka waktu tertentu dan/atau membatalkan<o:p></o:p>(i)  Syarat Pemakaian ini;<o:p></o:p>(ii) Akses terhadap penggunaan Layanan MediaStar apabila Pengguna melanggar Ketentuan Layanan ini.<o:p></o:p>Tanpa mengesampingkan aturan umum tersebut di atas, MediaStar memiliki hak untuk menghentikan dan/atau membatalkan Layanan MediaStar apabila MediaStar mengetahui bahwa Pengguna telah memberikan keterangan yang salah atau menyesatkan pada saat pendaftaran atau menyalahgunakan Layanan MediaStar.<o:p></o:p><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.55pt; font-size: 12pt; font-family: Arial, sans-serif;"><o:p> </o:p></h1><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.55pt; font-size: 12pt; font-family: Arial, sans-serif;">INFORMASI PENDAFTARAN<o:p></o:p></h1>Para Pengguna yang mendaftar untuk menggunakan Layanan harus memberikan informasi yang lengkap dan terbaru.<o:p></o:p><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.7pt; font-size: 12pt; font-family: Arial, sans-serif;"><o:p> </o:p></h1><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.7pt; font-size: 12pt; font-family: Arial, sans-serif;">MODIFIKASI LAYANAN MediaStar<o:p></o:p></h1>Dengan atau tanpa pemberitahuan, MediaStar dapat memodifikasi Layanan MediaStar atau menghentikan jasa layanannya kepada Pengguna tanpa perlu bertanggung jawab terhadap Pengguna maupun pihak ketiga. Pengguna tidak diperkenankan melakukan modifikasi dalam bentuk apapun terhadap Layanan MediaStar tanpa sepengetahuan dan persetujuan MediaStar.<o:p></o:p><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.5pt; font-size: 12pt; font-family: Arial, sans-serif;"><o:p> </o:p></h1><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.5pt; font-size: 12pt; font-family: Arial, sans-serif;">JAM OPERASI LAYANAN<o:p></o:p></h1>Pada prinsipnya, layanan tersedia 24 jam / 7 hari tanpa interupsi. Akan tetapi, Layanan dapat diberhentikan sementara dikarenakan oleh hal-hal operasional MediaStar atau kesulitan teknis, atau untuk sementara tidak tersedia untuk kurun waktu tertentu<o:p></o:p></div> <div class="WordSection2" style="caret-color: rgb(0, 0, 0); color: rgb(0, 0, 0); page: WordSection2;">yang ditetapkan oleh MediaStar untuk tujuan administrasi. Dalam hal ini, MediaStar akan memberikan pengumuman sebelum atau sesudahnya.<o:p></o:p><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.7pt; font-size: 12pt; font-family: Arial, sans-serif;"><o:p> </o:p></h1><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.7pt; font-size: 12pt; font-family: Arial, sans-serif;">HAK CIPTA KONTEN YANG DIPASANG<o:p></o:p></h1>Hak cipta dari konten yang dipasang di layanan MediaStar adalah sepenuhnya milik content providers, content developer yang telah bekerjasama dengan MediaStar sebagai penyelenggara layanan MediaStar. MediaStar memiliki hak untuk menyiarkan konten tersebut di dalam layanan.<o:p></o:p>Para pengguna MediaStar tidak diperbolehkan untuk mengunduh dan juga menduplikasikan seluruh isi konten dalam layanan MediaStar. Pelanggaran hak cipta dari konten yang dipasang diatur dalam undang-undang terkait.<o:p></o:p>Para pengguna tidak dapat memproses dan menjual informasi yang didapatkan dari layanan atau membiarkan pihak ketiga menggunakan materi konten yang dipasang di layanan untuk tujuan komersial. Pelanggaran hak cipta dari konten yang dipasang diatur dalam undang-undang terkait.<o:p></o:p><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.55pt; font-size: 12pt; font-family: Arial, sans-serif;"><o:p> </o:p></h1><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.55pt; font-size: 12pt; font-family: Arial, sans-serif;">LAYANAN KONSUMEN<o:p></o:p></h1>MediaStar harus menanggapi secara cepat seluruh keluhan para pengguna terhadap layanan. Dalam hal, penjelasan singkat mengenai keluhan tersebut sulit dilakukan, MediaStar akan memasang alasannya di layar layanan atau melaui email dan akan merencanakan peningkatan layanan.<o:p></o:p><o:p> </o:p>MediaStar bersandar pada Kitab Undang Undang Hukum Pidana, Kitab Undang Undang Hukum Perdata, Undang-Undang tentang Perlindungan Konsumen, Undang Undang tentang               Informasi       dan      Transaksi    Elektronik  dan undang-           undang            serta peraturan-peraturan terkait lainnya untuk mengoperasikan dan menyediakan Layanan.<o:p></o:p><o:p> </o:p>KEWAJIBAN PENGGUNA<o:p></o:p>Dalam menggunakan layanan, para Pengguna dilarang melakukan hal-hal berikut :<o:p></o:p>1.  Memberikan informasi palsu ketika mendaftar dan memperbaharui informasi atau dengan tidak legal menggunakan ID Anggota lainnya.<o:p></o:p>2.    Menggandakan, mendistribusikan, atau secara komersial menggunakan informasi yang didapatkan dari Layanan MediaStar.<o:p></o:p>3.  Memasang konten tidak senonoh atau memasang link ke halaman WEB yang tidak senonoh ke dalam Layanan.<o:p></o:p>4.  Berkomunikasi dengan pihak lain dengan informasi, tulisan, gambar atau suara yang mengganggu ketertiban publik dan mengabaikan moral.<o:p></o:p></div> <div class="WordSection3" style="caret-color: rgb(0, 0, 0); color: rgb(0, 0, 0); page: WordSection3;">5.  Memasang atau mendistribusikan materi yang berisi virus komputer yang menyebabkan tidak berfungsinya peralatan yang berhubungan dengan Layanan, merusak informasi dan menghasilkan kekacauan.<o:p></o:p>6.  Secara sengaja mengganggu operasional Layanan, mengirimkan informasi yang mungkin menginterupsi pengiriman Layanan.<o:p></o:p>7.  Mendistribusikan informasi palsu untuk kepentingan keuntungan moneter pribadi atau pihak lain, atau mencelakai keinginan pihak-pihak lain.<o:p></o:p>8.  Merubah atau mengganti informasi yang dipasang di Layanan.<o:p></o:p>9.  Mengancam Anggota lainnya, termasuk menguntit mereka.<o:p></o:p>10.     Melanggar ketentuan-ketentuan dalam Kitab Undang Undang Hukum Pidana, Kitab Undang Undang Hukum Perdata, Undang Undang tentang Informasi dan Transaksi Elektronik, Undang Undang tentang Hak Cipta atau melakukan Aktivitas ilegal atau kriminal lainnya.<o:p></o:p><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.55pt; font-size: 12pt; font-family: Arial, sans-serif;"><o:p> </o:p></h1><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.55pt; font-size: 12pt; font-family: Arial, sans-serif;">PEMBEBASAN<o:p></o:p></h1>Pengguna setuju untuk menjamin dan membebaskan MediaStar, subsidiari dan atau afiliasinya, serta Direktur-direktur, komisaris-komisaris, pejabat, pegawai, agen dan wakil-wakilnya dari segala gugatan atau tuntutan, termasuk biaya pengacara yang wajar, yang dilakukan oleh pihak ketiga atas atau yang timbul dari penggunaan Layanan MediaStar oleh Pengguna, pelanggaran atas Ketentuan Layanan ini oleh Pengguna, atau pemalsuan suatu Hak Atas Kekayaan Intelektual oleh Pengguna, dari Hak Atas Kekayaan Intelektual atau hak lain yang dimiliki orang atau badan lain.<o:p></o:p><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.4pt; font-size: 12pt; font-family: Arial, sans-serif;"><o:p> </o:p></h1><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.4pt; font-size: 12pt; font-family: Arial, sans-serif;">KETENTUAN HUKUM YANG BERLAKU<o:p></o:p></h1>Para Pengguna harus mematuhi undang-undang terkait, peraturan dalam Perjanjian ini, Petunjuk Penggunaan dan pemberitahuan yang dipasang di layar Layanan serta pengumuman lainnya yang diberikan, dan tidak mengambil bagian dari aktivitas yang mengganggu kelancaran layanan MediaStar.<o:p></o:p><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.55pt; font-size: 12pt; font-family: Arial, sans-serif;"><o:p> </o:p></h1><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.55pt; font-size: 12pt; font-family: Arial, sans-serif;">WILAYAH YURIDIKSI<o:p></o:p></h1>Jika terjadi perselisihan antara Perusahaan dan Anggota mengenai penggunaan Layanan, Perusahan dan Anggota berusaha untuk menyelesaikannya dengan musyawarah mufakat. Dalam hal perselisihan tersebut apabila tidak dapat diselesaikan dapat mengajukan tuntutan di pengadilan sesuai dengan Undang Hukum Perdata.<o:p></o:p><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.55pt; font-size: 12pt; font-family: Arial, sans-serif;"><o:p> </o:p></h1><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.55pt; font-size: 12pt; font-family: Arial, sans-serif;">UPAYA-UPAYA ATAS PELANGGARAN KETENTUAN INI OLEH PENGGUNA<o:p></o:p></h1>Apabila MediaStar memutuskan, berdasarkan pertimbangannya sendiri, bahwa Pengguna telah melanggar suatu bagian Ketentuan Layanan ini, atau telah terbukti melakukan tindakan yang tidak pantas terhadap Layanan MediaStar, maka MediaStar berhak untuk<o:p></o:p>(i)  memberikan peringatan kepada Pengguna bahwa Pengguna telah melanggar Ketentuan Layanan ini;<o:p></o:p>(ii)  menghentikan Layanan MediaStar kepada Pengguna;<o:p></o:p></div> <div class="WordSection4" style="caret-color: rgb(0, 0, 0); color: rgb(0, 0, 0); page: WordSection4;">(iii)   memberitahukan dan/atau bekerja sama secara penuh dengan Aparat Penegak Hukum atau Pejabat yang berwenang lainnya untuk langkah selanjutnya; dan/atau.<o:p></o:p>(iv) melakukan tindakan lainnya yang menurut pertimbangan MediaStar tepat dan sesuai.<o:p></o:p><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.7pt; font-size: 12pt; font-family: Arial, sans-serif;"><o:p> </o:p></h1><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.7pt; font-size: 12pt; font-family: Arial, sans-serif;">KUALITAS LAYANAN STREAMING<o:p></o:p></h1>Merupakan Kualitas Best Effort yang sesuai dengan kualitas bandwidth internet yang dimiliki oleh Pelanggan.<o:p></o:p><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.7pt; font-size: 12pt; font-family: Arial, sans-serif;"><o:p> </o:p></h1><h1 style="margin: 0cm 0cm 0cm 5pt; line-height: 13.7pt; font-size: 12pt; font-family: Arial, sans-serif;">LAIN-LAIN<o:p></o:p></h1>Apabila suatu ketentuan dalam Ketentuan Layanan ini bertentangan dengan hukum yang berlaku bagi Ketentuan Layanan ini atau apabila suatu ketentuan dinyatakan tidak berlaku oleh pengadilan yang berwenang mengadili para pihak dari Ketentuan Layanan ini, Ketentuan tersebut akan dianggap untuk dinyatakan kembali agar mencerminkan sedekat mungkin tujuan awal para pihak sesuai dengan hukum yang berlaku, dan Ketentuan Layanan lainnya dari Ketentuan Layanan ini masih tetap berlaku efektif.<o:p></o:p>Kegagalan satu pihak untuk memaksa atau melaksanakan kepada pihak lainnya kewajiban sesuai Ketentuan Layanan ini atau melaksanakan hak berdasarkan Ketentuan Layanan ini, tidak akan dianggap sebagai pengesampingan atau pelepasan suatu hak dari salah satu pihak untuk menuntut atau menggantungkan pada ketentuan atau hak di dalamnya atau kejadian lainnya, akan tetapi, hal yang sama akan tetap berlaku.<o:p></o:p>MediaStar dapat mengalihkan hak dan kewajibannya berdasarkan Ketentuan Layanan ini dan atas pengalihan tersebut MediaStar dapat dilepaskan dari setiap kewajibannya berdasarkan Ketentuan Layanan ini.<o:p></o:p><o:p> </o:p>Ketentuan Layanan ini dan Ketentuan Tambahan lainnya adalah merupakan peraturan kesepakatan menyeluruh antara para pihak berkaitan dengan permasalahan yang diatur dalam Ketentuan Layanan ini, dan menggantikan semua kesepakatan dan pengertian yang telah ada sebelumnya. Setiap ketentuan dari Ketentuan Layanan ini yang tidak bisa secara hukum dilaksanakan, akan, atas pilihan MediaStar, dihapuskan atau dimodifikasi untuk memperbaiki kesalahan tersebut dan, tanpa kecuali, ketentuan lain dari Ketentuan Layanan ini masih akan tetap berlaku dan dapat dilaksanakan.<o:p></o:p></div> <o:p> </o:p>
